Terms & Conditions
General
(1) These terms of use (“Terms of Use”) of JOLT (as defined below) together with the JOLT Privacy Policy govern your use of Charging Stations (as defined below), mobile applications, credit cards, RFID cards and/or websites operated by JOLT under its own brand or under its Partners’ (as defined below) brand or through mobility service providers (“MSPs”) (“Service”).
(2) “JOLT” in these Terms of Use shall mean Jolt Energy Limited, Jolt Energy GmbH, Jolt Sweden AB or Jolt The Netherlands B.V., as the case may be.
(3) ”Partners” in these Terms of Use shall mean all of JOLT’s business partners that are authorized to operate parts of the Service on behalf of JOLT, including but not limited to app providers, billing service providers, credit card providers and customer service providers.
(4) “Charging Station” in these Terms of Use shall mean fast charging solutions for electric vehicles.
(5) “Charging Session” in these Terms of Use shall mean the use of a Charging Station to charge an electric vehicle.
Acceptance
(1) By registering for or using the Service or any portion of it, in particular by starting a Charging Session, you accept these Terms of Use.
(2) You will be notified by JOLT about changes to these Terms of Use before using the Service through the JOLT mobile application. JOLT has the right to terminate the Service if the changes are rejected. If you do not express disapproval before using the Service, JOLT will assume your consent and the changes will enter into force.
Prices
(1) All applicable initial prices of the charging through the Service are valid inclusive of VAT and are indicated before the start of the Charging Session. Initial prices may be displayed as fees per kWh of energy, fees per time of parking of an electric vehicle at the Charging Station, Charging Session starting fees, as well as any other indicated initial fees. You acknowledge that the final price of the Charging Session is not always automatically provided before the start of the Charging Session, but is dependent on your use, for example kWh value of consumed energy and/or the duration of the Charging Session, whereas longer Charging Sessions may incur higher fees.
(2) You are aware that if you choose to use the Service though any third-party mobile applications and/or services that are not supplied directly by JOLT, JOLT has no control over the price that is charged by such third party.
(3) If you use the JOLT mobile application to initiate a charging session at a charging station that is not operated by JOLT, the price of charging will be displayed in the JOLT mobile application.
(4) JOLT reserves the right to charge a blocking fee in case the Charging Session is not terminated and the vehicle is not removed from the Charging Station after the vehicle has been fully charged.
Your Obligations
(1) It is your responsibility to ensure that the Charging Session begins and is completed correctly and you shall not use Charging Stations that show an error message or visible defects or damages.
(2) It is your responsibility to ensure that the registered payment card is valid, that it has a sufficient balance and is not blocked. In the event that debiting is not possible, JOLT has the right to seek payment from you by other means, such as by sending a separate invoice for your use of the Service. As it is your responsibility to ensure that your payment information on the JOLT account is up-to-date and valid at the time of attempting to purchase a Charging Session through the Service, failure to do so can result in JOLT closing your account without prior notice.
(3) Upon registering you shall provide your email address and a chosen password for logging into your JOLT account. You must take due care to protect your password against misuse by others and promptly notify JOLT about any misuse. You are responsible for keeping the password secure, for not writing the password down so that third parties can understand what it is used for, and for not using the password in any other way that allows others to gain access to the Service.
(4) The Service is personalized, and the JOLT account is not to be shared with third parties. Any misuse of the Service may lead to termination of the Service without prior notice.
(5) You are responsible for complying with the specific parking restrictions and regulations at the Charging Station, such as the written instructions shown at the Charging Station or at the parking area where the Charging Station is located and/or the instructions given by the on-site personnel.
Charging Stations
(1) You can start Charging Sessions at the Charging Stations that are available through the Service using the JOLT mobile application, a third-party mobile application, credit card or RFID card. If available, you may be able to start a Charging Session by scanning a QR code available at the Charging Station. The Charging Station will be activated, provided it is operative and functional.
(2) Through the JOLT mobile application and/or through a JOLT RFID card, JOLT might offer access to Charging Stations of other Charge Point Operators. JOLT cannot guarantee the functionality or availability of such Charging Stations or the accuracy of such information.
(3) The electric vehicle that is charged at a Charging Station and the tools to be provided by you shall be fit for their purpose, compatible for the connection with the Charging Station and satisfy all applicable legal provisions at the relevant times. The use of adapters and similar equipment is not allowed. JOLT is not liable if a defect or damage is caused by a defect in the electric vehicle and/or the used tools. If the use of adapters, etc. causes damage to a Charging Station you may be held responsible for any damage caused.
Payment Terms
(1) JOLT mobile application/JOLT RFID card: The billing of the Charging Sessions activated within a calendar month takes place at the first day of the following month. The invoiced amount is immediately due for payment. JOLT only sends invoices or receipts to you electronically. You can obtain information regarding past billing and standing balance from the current month that has not yet been invoiced by logging into your account.
(2) Credit Card Terminal Payments: When starting a Charging Session, you will be asked to select a maximum number of kWh to be charged at a certain price, thereby also indicating the price/kWh. The shown amount will be pre-authorized. After finishing the Charging Session JOLT will capture the correct amount for the Charging Session.
(3) MSPs: The MSP will bill you for the electricity consumed during the Charging Session.
(4) Complaints regarding incorrect charging costs are processed and determined by JOLT. If a complaint is accepted, JOLT is to compensate you for the amount without delay. If a complaint is rejected, JOLT shall inform you of the result of the investigation of the complaint and justify the position of JOLT. If you are using an MSP, you need to contact the MSP for any complaints around costs.
(5) The Partners may charge you separately for parts of the Service.
Unauthorized Use of the Service
(1) You are obligated to immediately notify JOLT if you believe that your account or JOLT RFID card has been used by an unauthorized person or in an unauthorized manner.
(2) In the event of the loss of your JOLT RFID card or the mobile phone having the JOLT mobile application on it, you shall immediately notify JOLT. If you do not give such notification and the JOLT RFID card or the mobile phone in question remains in illegitimate use, JOLT reserves the right to claim all losses incurred as damage from you.
(3) JOLT will block the JOLT RFID card following receipt of notification of its loss or theft and such blocked RFID card cannot be reactivated. You will, however, be able to place an order for a new JOLT RFID card with JOLT, according to the applicable terms and conditions.
Website
(1) By using a website operated by JOLT, you certify that you have read and reviewed these Terms of Use and that you agree to comply with them. If you do not want to be bound by these Terms of Use, you need to refrain from using the website. JOLT only grants use and access of this website, its products, and its services to those who have accepted these Terms of Use.
(2) Before continuing to use a website operated by JOLT, you are advised to read the JOLT Privacy Policy regarding our user data collection. It will help you better understand our practices.
(3) You agree that all materials, products, and services provided on a website operated by JOLT are the property of JOLT, its affiliates, directors, officers, employees, agents, suppliers, Partners, or licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute JOLT’s intellectual property in any way, including electronic, digital, or new trademark registrations.
(4) As a user of a website operated by JOLT, you may be asked to register and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password. If you think there are any possible issues regarding the security of your account on the website, inform JOLT immediately so the issues may be addressed accordingly.
(5) JOLT reserves all rights to terminate accounts, edit or remove content and cancel orders at its sole discretion.
(6) JOLT is not liable for any damages that may occur to you as a result of your misuse of a website operated by JOLT.
JOLT RFID Card
(1) JOLT may offer the ordering of JOLT RFID cards through the Service. The price for the JOLT RFID card, the payment formalities and estimates as to the delivery will be shown to you during the order process.
(2) The order is an offer to JOLT to purchase the JOLT RFID cards. Any confirmation of the order by JOLT is merely an acknowledgement and does not constitute acceptance. Acceptance of the order, and the formation of the contract for the sale and purchase of the ordered JOLT RFID cards shall be deemed to take place when JOLT ships the ordered JOLT RFID cards and informs you accordingly.
Liability
(1) JOLT shall not be responsible for and shall have no liability hereunder in respect of:
(i) the continuous availability and operability of (a) the public electricity, internet and communication infrastructure needed for the Charging Session, unless JOLT has caused the unavailability or inoperability of the infrastructure by fault; and (b) the Charging Stations;
(ii) the suspension of the Service for reasons which ultimately prove to be incorrect, but, JOLT had, at the time of suspension, reason to believe that there were grounds for suspension.
(2) JOLT is not responsible for any indirect damages or losses, such as loss of income or damage to the relationship between you and third parties, except if the damage or loss is caused by negligence (only, however, if you are a consumer), gross negligence or willfulness on the part of JOLT, and never in excess of what you are entitled to under mandatory legislation.
(3) This Sec. 10 describes the entire liability of JOLT. The only exception to this are mandatory legal provisions that apply to JOLT’s liability for defects to the extent these cannot be excluded by mutual agreement.
Force Majeure
JOLT is not liable hereunder to you for any delay or non-performance of its obligations. In the event such delay or non-performance is due to official action, change in law, war, sabotage, failure or delay in delivery, irregularities in the supply of electricity, telephone connections or other traffic and communications connections and transportation, strike, boycott, or other similar circumstances beyond the reasonable control of JOLT (for the avoidance of doubt, matters that are only within the reasonable control of JOLT’s subcontractors shall not be deemed to be within JOLT’s reasonable control). The aforementioned also applies if JOLT is the subject of a strike, boycott and/or blockade.
Duration and Termination
(1) The duration of the Service is mentioned in the JOLT mobile application and will be provided by JOLT until the end of the term or until JOLT terminates the Service.
(2) You may terminate your account if you no longer wish to use the Service. After termination, you will no longer have access to the Service. JOLT may terminate your registration or restrict access to certain parts of the Service if JOLT reasonably believes that you have breached these Terms of Use.
(3) After termination, you will be charged for any outstanding amounts from Charging Sessions that have taken place prior to the termination.
Data Protection
(1) JOLT or the Partners collect, process and use data pertaining to you for the implementation of the contractual relationship pursuant to the provisions of the General Data Protection Regulation (EU 2016/679) and other applicable national data protection legislation.
(2) The unique identification number that is used to identify you, personal details and transactional details may be transferred to the producer of the Charging Station for the purpose of activating the Charging Stations, solving potential issues regarding the charging service and invoicing. Personal details, contact details and transactional details may also be transferred to the Partners for the purpose of invoicing and customer service.
(3) More information on JOLT’s processing of personal data can be found in the JOLT Privacy Policy.
(4) JOLT may use non-personal data collected in the provision of the Service in order to (i) improve the Service and its other products and services, and (ii) share statistical information with its Partners.
Severability
These Terms of Use neither exclude nor limit any of your mandatory rights in the country of residence that cannot by law be waived. If a provision of these Terms of Use is found to be invalid, the remaining provisions will not be affected, and the invalid provision will be replaced with a valid provision that comes closest to the result and purpose of these Terms of Use. If certain parts of these Terms of Use are not relevant for your use of the Service, it shall not impact the validity or enforceability of any other provision of the Terms of Use or the Terms of Use as a whole. The provisions of the Terms of Use that are intended to survive termination of your registration remain valid after such termination.
Governing Law and Jurisdiction
(1) These Terms of Use are governed by the laws of the country of registration of the relevant JOLT entity.
(2) If you are a businessperson and if the eventual dispute with JOLT is attributable to the conducting of your trade or any business activity, JOLT can sue you and can be sued by you only before the courts of the seat of the relevant JOLT entity. If you are a consumer, this limitation does not apply to you.
(3) You have the following additional out-of-court options: At http://ec.europa.eu/consumers/odr/, the European Commission has set up a European Online Dispute Settlement Platform (OS Platform). Consumers can use the OS Platform for the out-of-court settlement of a dispute resulting from online contracts entered into with an enterprise registered in the EU.
